This Privacy Policy explains how Nikola Innovations Limited ("Company," "we," "us," "our"), operating foundr.video ("the Service"), collects, uses, stores, and protects your personal data. By using the Service, you consent to the practices described in this policy.

1. Information We Collect

Account information. When you create an account, we collect your name, email address, and password. If you subscribe to a paid plan, our payment processor (Polar) collects your billing information — we do not directly store your credit card or bank details.

Truth Sheet data. You provide product information including company name, product name, features, pricing tiers, use cases, social proof, and website URLs. This data forms the basis for video generation and accuracy verification.

Uploaded assets. You may upload screenshots, logos, images, and other media files for use in video composition.

Generated content. We store scripts, voice audio files, avatar videos, and composed final videos generated through the Service.

Usage data. We automatically collect technical information including IP address, browser type, operating system, pages visited, features used, and timestamps. This data is used for analytics, security, and Service improvement.

Cookies. We use essential cookies for authentication and session management. We do not use third-party tracking cookies or advertising cookies. See Section 8 for details.

2. How We Use Your Information

• Provide the Service: Generate scripts, voice narration, avatars, and composed videos from your Truth Sheet data and uploaded assets.
• Verify content accuracy: Compare generated scripts against your Truth Sheet to flag potential inaccuracies before you approve them.
• Process payments: Manage subscriptions, credits, and billing through our payment processor.
• Communicate with you: Send transactional emails (account confirmations, credit notifications, approval reminders), and respond to support requests.
• Improve the Service: Analyze usage patterns to identify bugs, improve performance, and develop new features. We do not use your content to train AI models.
• Ensure security: Detect and prevent fraud, abuse, and unauthorized access.
• Comply with legal obligations: Respond to lawful requests from authorities and fulfill tax and financial reporting requirements.

3. Legal Basis for Processing (GDPR)

If you are in the European Economic Area (EEA) or the United Kingdom, we process your personal data on the following legal bases:

• Contract performance: Processing necessary to provide the Service you subscribed to (account management, video generation, credit tracking).
• Legitimate interest: Analytics, security monitoring, and Service improvement, where our interests do not override your rights.
• Legal obligation: Tax reporting, fraud prevention, and responses to lawful government requests.

4. Third-Party Service Providers

To provide the Service, we share certain data with third-party AI and cloud service providers. These providers process your data solely on our behalf and under our instructions:

• AI content generation providers: Your Truth Sheet data and uploaded images are processed by third-party AI services to generate scripts, verify claims, synthesize voice narration, render avatar videos, and compose final videos.
• Payment processor (Polar): Handles subscription billing, payment processing, and invoicing. Polar acts as the Merchant of Record.
• Cloud infrastructure: Your data is stored on cloud database and storage services with industry-standard encryption at rest and in transit.
• Social publishing (optional): If you use the publishing feature, your generated videos are transmitted to the social media platforms you authorize.

We select providers that maintain appropriate data protection standards. We do not sell, rent, or trade your personal data to any third party for their own marketing purposes.

5. International Data Transfers

Nikola Innovations Limited is based in Nigeria. Your data may be processed in countries outside Nigeria, including the United States and the European Union, by our third-party service providers. These transfers are necessary to provide the Service and are made in compliance with applicable data protection laws. Where required, we rely on appropriate safeguards such as standard contractual clauses.

6. Data Retention

• Active accounts: We retain your data for as long as your account is active and as needed to provide the Service.
• After account closure: Upon account deletion, we remove your personal data, Truth Sheets, uploaded assets, and generated videos within 30 days. Anonymized usage data and aggregated analytics may be retained indefinitely.
• Financial records: Billing records, transaction history, and credit ledger data are retained for 7 years to comply with tax and financial reporting obligations.
• Legal holds: If your data is subject to a legal hold, preservation request, or ongoing dispute, we may retain it beyond the normal retention period as required by law.

7. Your Rights

Depending on your jurisdiction, you may have the following rights:

• Access: Request a copy of the personal data we hold about you.
• Correction: Request correction of inaccurate personal data.
• Deletion: Request deletion of your personal data (subject to legal retention requirements).

• CSRF protection cookies: Prevent cross-site request forgery attacks. Session-scoped.
• Preference cookies: Store your UI preferences (e.g., sidebar state). Persist for 30 days.

We do not use advertising cookies, analytics cookies from third parties, or cross-site tracking cookies.

9. Data Security

We implement industry-standard security measures to protect your data, including encryption at rest and in transit (TLS 1.2+), access controls, regular security audits, and secure credential management. However, no method of electronic storage or transmission is 100% secure. We cannot guarantee absolute security.

10. Data Breach Notification

In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify affected users by email within 72 hours of becoming aware of the breach. We will also notify relevant supervisory authorities as required by applicable law.

11. Children's Privacy

The Service is not intended for use by anyone under the age of 18. We do not knowingly collect personal data from children. If you believe we have inadvertently collected data from a minor, contact us at support@foundr.video and we will delete it promptly.

13. Automated Decision-Making

The Service uses automated AI systems to generate scripts, verify claims, synthesize voice, and compose videos. These automated processes produce content recommendations that you review and approve through our human-in-the-loop process before any final output is generated. No fully automated decisions with legal or significant effects are made about you without human review.

14. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or a prominent notice on the Service at least 30 days before they take effect. The "Last updated" date at the top of this page reflects the most recent revision.
